FRIA facilitation protocol (PR-27-FRIA)
PR-27-FRIA structures and checks the fundamental rights impact assessment that Art. 27(1) requires before first use of a high-risk AI system. The duty falls on bodies governed by public law, private entities providing public services, and deployers of Annex III point 5(b) and (c) systems. Five elements are checked against an observable result; the other elements are assembled as records. It produces a versioned assessment record aligned to ISO/IEC 42005:2025Published, an affected-groups mapping and a risks of harm register. The register holds the bias and accuracy evidence; a notification checklist completes the outputs.

PR-27-FRIA v1.0 is built from ISO/IEC 42005:2025Published and Art. 27 of Regulation (EU) 2024/1689.
Scope
The protocol covers a high-risk AI system referred to in Art. 6(2) at the point where a deployer named in Art. 27(1) prepares its first use. Systems intended for the area of Annex III point 2 are outside the duty and outside the protocol. The deployer's other duties under Art. 26 are covered by PR-14-OVR v1.0 and PR-12-LOG v1.0; the record on Art. 27 lists the split for this article. Under the working reading the duty applies from the Annex III application date Deferred; the alternative reading is shown under Limitations.
The protocol covers three kinds of element. The five testable elements of the obligation record are checked against an observable result:
- the context of use, against the intended purpose and conditions of use in the instructions for use
- each risk of harm, against its affected group and the provider's information under Art. 13
- the human oversight measures, against the measures in place in the deployment
- the complaint mechanism, with a synthetic test complaint
- each cross-reference to a data protection impact assessment, against the section it cites
The ten documentation elements of the obligation record are assembled into one record whose sections follow the clauses of ISO/IEC 42005:2025Published. The four process elements of the obligation record are recorded as triggers and owners; the protocol does not observe them over the period of use.
The protocol does not decide whether the deployer falls within Art. 27(1) or whether the system is high-risk. It does not decide whether a case is similar enough for reliance under Art. 27(2). Those are classification and legal questions; the protocol records the deployer's determination and the counsel reference behind it. The protocol does not produce bias or accuracy evidence. It integrates the outputs of PR-10-BIAS v1.0 and PR-15-ROB v1.0 where they exist and the provider's declarations under Art. 13(3) otherwise. The protocol does not perform or assess the data protection impact assessment. The limits of the service that uses the protocol are stated on what we cannot do.

Thresholds and criteria
Regulation (EU) 2024/1689 sets no numeric threshold for Art. 27: no likelihood, severity or acceptance value is given for a risk of harm. The pass criterion for each check is a consistency criterion taken from the text of the article. The risk rating uses a scale the deployer sets and justifies.
| Check | Criterion | Source |
|---|---|---|
Context of use (step 13) | Each described context of use falls within the intended purpose and the conditions of use in the instructions for use. Each condition found only in promotional or technical materials is recorded with its source. | Art. 27(1)(a) |
Risk of harm (step 18) | Each register row names one category or group from the mapping and one instructions-for-use section with Art. 13 information. A row with no such section is an open item for the provider. | Art. 27(1)(d), Art. 13(3)(b) |
Human oversight (step 24) | Each measure set out in the instructions for use has an observed role, control and trigger in the deployment. Each unobserved measure is a gap. | Art. 27(1)(e) |
Complaint mechanism (step 28) | Each channel accepts the synthetic test complaint and the receiver is the governance arrangement named in the assessment. | Art. 27(1)(f) |
Cross-reference (step 30) | Each cited section of the data protection impact assessment holds the content of the Art. 27(1) element it is cited for. | Art. 27(4) |
The source of each criterion follows the hierarchy stated on the Art. 27 obligation page. No harmonised standard covers the fundamental rights impact assessment. No harmonised standard is cited in the Official Journal as of the anchor date, so no presumption of conformity exists. No JTC 21 draft in the standards tracker addresses Art. 27. The level in use is an ISO/IEC standard. ISO/IEC 42005:2025Published supplies the process and the structure of the record. Its clause §5.7 places the setting of thresholds and impact scales with the organisation. It sets no acceptance value. The deployer sets its own likelihood and severity scale and justifies each level against the context of use and the affected groups. Step 10 records that justification and step 31 applies the scale. A check marked "not verifiable" at step 32 states what evidence was missing.

Limitations
The protocol cannot show that the deployer is within Art. 27(1) or that the system is high-risk under Art. 6(2). It cannot show that a case is similar for reliance under Art. 27(2). It records the deployer's determination and the counsel reference. The protocol cannot show that the assessment was performed before the first use of the system. The approval entry carries the record version; the timing of first use is a process element the deployer evidences.
The protocol cannot show that the list of affected groups is complete. Identification of interested parties under ISO/IEC 42005:2025Published depends on the deployer's knowledge of its processes and on consultation the protocol does not perform. The protocol cannot show that the deployer's likelihood and severity scale is adequate; no published threshold exists, and step 10 records the deployer's justification only.
The test complaint at steps 27 and 28 shows that a channel accepts a complaint and routes it to the named arrangement. It does not show how complaints are handled over the period of use. The cross-reference check at step 30 shows that a cited section holds the content of the element it is cited for. It does not assess the data protection impact assessment against its own legal basis. Where no PR-10-BIAS v1.0 or PR-15-ROB v1.0 report exists and the instructions for use carry no Art. 13 information, the risks of harm stay open items. The protocol does not produce that evidence.
Where the AI Office template under Art. 27(5) is not yet issued, the notification checklist follows the Art. 27(1) elements and the content of Art. 27(3). The record then lists a re-run of step 38 as a review trigger.
